Why Buy an EB-5 Regional Center?

An EB-5 Regional Center is responsible for sponsoring capital investment projects for EB-5 investors. An EB-5 investor is anyone who holds an EB-5 visa. This visa is called the “employment-based fifth preference category” or the “EB-5 Immigrant Investor Visa Program (established in 1990).

Details of The Program
If you participate in the EB-5 program, you’ll probably invest in a targeted employment area, or TEA. This is a rural area of the country that may also have a high unemployment rate. Some urban areas with high unemployment rates also fall into the TEA listings.
The great thing is that, to encourage investments in TEAs, the investment threshold to get your green card will actually be lowered if you choose to do so. In other words, if you invest in a TEA, you will only have to invest $500,000 compared to $1,000,000.
It’s important to note that an EB-5 Regional Center (RC) is a service agent organization. It operates for both investors and companies who want to complete a project for the EB-5 program. The regional center can be a public or private entity.
An EB-5 Regional Center focuses on promoting increased domestic capital along with creating jobs and increasing regional productivity through the projects they assist with.
Why Opt for a Regional Center’s Help?
Generally, EB-5 investors will turn to a regional center if they are focused on getting residency status. That’s because the regional center will allow you to pursue that goal without you needing to worry about directly managing the investment yourself.
You will find it easier to go through a regional center for this reason. The RC will set up an investment fund for your benefit rather than having you invest directly into a project. As an investor, you can then purchase an equity stake in the regional center’s investment fund.
That fund will do one of two things. It can either purchase equity in a job creating entity (known as the equity model) or it can loan the job creating entity money (known as the loan model). That entity will then use the investment to indirectly create jobs.
An EB-5 regional center offers multiple advantages. These include:
- USCIS will count indirect, induced, and direct jobs associated with the projects towards the job creation requirements. This allows you to meet the requirements for residency more easily. Investors will not need to be involved in the daily management of the business. Investors can instead participate in the fund’s policy formation. Investors can then participate as a limited partner or member, respectively, and receive all of the benefits of the State’s Uniform Limited Partnership Act or Limited Liability Company Act.
- Adding to the above, this setup means you do not have to dedicate a certain amount of time to direct the business. You will not have to be directly involved in the business. That means investors who opt to go through a regional center spend substantially less time dealing with business management. It’s much more hands-off.
- You can live anywhere in the United States if you opt for the regional center investment model. This makes it a very attractive option because you will not have to live near the investment project. You can also work anywhere because your employment will not be tied to the project.
- Additionally, the ability to bring your spouse and children with you to the United States, makes the EB-5 program a great option for legal statuses.
